Terms of Service

1. Service Description
Court Case Alert™ is a judicial data retrieval and case monitoring platform operated by Spinks Technologies, Inc. We provide automated discovery fulfillment by bridging the gap between court record systems and modern practice management software. We act as an Automated Agent on behalf of the user to retrieve, verify, and deliver official court filings and case data.
2. Professional Status
Spinks Technologies, Inc. is a technology infrastructure provider. We are not a law firm, we do not provide legal advice, and our employees are not acting as your attorneys. The use of the Service does not create an attorney-client relationship between you and Spinks Technologies, Inc.
3. Fees and Billing
Per-Case Discovery Fee: A per-case fee (currently $49.00) is charged for the automated retrieval, verification, and classification of discovery artifacts for a given case. This fee covers all documents associated with that case. The characterization of this fee for client billing purposes is the sole responsibility of the subscribing attorney or firm.
Platform Subscriptions: Monthly or annual subscriptions provide access to the case monitoring, analytics, and practice management integration features of the platform. Subscription fees are non-refundable. Court-imposed filing restrictions or access limitations are outside the control of Spinks Technologies, Inc. and do not entitle users to refunds.
4. Data Retrieval Methods
We retrieve court records through authorized API access and authenticated sessions provided by court record management systems. All data retrieval is performed in compliance with applicable terms of use governing the source systems. All judicial data retrieved belongs to the respective county, court, or jurisdiction; Spinks Technologies, Inc. claims no ownership of underlying public records.
5. Data Security and Storage
We take the security of your data seriously. All data is encrypted at rest using AES-256 server-side encryption and in transit using TLS 1.2 or higher. Access to stored data is governed by role-based access controls and scoped to the authenticated user or firm that submitted the request.
Discovery artifacts (court filings, case documents) are stored securely in our cloud infrastructure for retrieval and integration with your practice management software. 6. Third-Party Integrations
The Service may integrate with third-party practice management platforms (e.g., Clio, MyCase) at your direction. When you authorize a third-party integration, we will access and transmit data to that platform on your behalf using industry-standard OAuth 2.0 authorization. You are responsible for reviewing and accepting the terms of service of any third-party platform you connect. Spinks Technologies, Inc. is not responsible for the data handling practices of third-party platforms once data has been transmitted at your request.
7. Limitation of Liability
The Service is provided “as is” and “as available.” Spinks Technologies, Inc. makes no warranties, express or implied, regarding the accuracy, completeness, or timeliness of court data retrieved through the platform. Court records are sourced from public systems maintained by county and state authorities; we are not responsible for errors or omissions in the underlying source data. In no event shall Spinks Technologies, Inc. be liable for indirect, incidental, special, or consequential damages arising from the use of the Service.
8. Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in activity that disrupts the Service, or use the platform in a manner that violates applicable law. You may cancel your subscription at any time by contacting us. Upon cancellation, access to the platform will continue through the end of your current billing period.
9. Modifications to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in DeKalb County, Georgia.
